LAW - 6002 Military Law

The objectives of this course are to deliver an overview of the law that the men and women in our Armed Forces are subject to and the special issues they face arising there from. This course will start by offering an analysis of military law, the sources of military law, and the federal and state government’s respective constitutional and statutory authority to create, manage, and dismantle various branches of the military. Additionally, this portion of the course may also include an overview of the military’s structured rank system, and the authority and/or duties that ranking officers have to implement procedures of military law. Continuing, the course will move to a study of the structure of a military court system/tribunal, and the roles of the Judge Advocate General and Military Judge in the same. Further, this portion of the course will consist of a study of the military’s adjudicative proceedings from inception to conclusion, including available disciplinary remedies. As an illustration, the course then compares and contrasts these procedures with civil and criminal proceedings in our state and federal court systems. Finally, the class will apply their knowledge of military laws and proceedings to discussions of controversial modern military issues (i.e. Guantanamo detainees, the War on Terror, use of private mercenaries and contractors in Iraq and Afghanistan, the military’s “Don’t Ask, Don’t Tell,” etc.).
