LAW - 5873 Family Law in the World Community(3 hours)
Family Law in the Word Community explores issues related to the creation and dissolution of families and the interaction among family members from comparative, international, and human rights perspectives. Although topics may vary somewhat from year to year, depending on the expressed interests of the class, three goals remain constant. To prepare students for transnational family law practice in U.S. courts by examining the treaties, statutes, regulations, and common law governing the recognition of foreign marriages and divorces and related financial orders, adjudication of international child custody disputes, and the regulation of international adoption. To examine the impact of international human rights law on the domestic and international regulation of families, particularly in the context of domestic violence issues. And, to introduce comparative law methodology by examining various family law issues - such as limitations on who may marry and/or the grounds and regulation of divorce - from a comparative and global perspective. In the context of issues related to international family law, students are introduced to basic international law terminology and principles regarding the sources of international law, treaty formation and interpretation, the global and regional human right systems, and the basic structure and legal systems of the principal global and regional international organizations that create and enforce international family law norms. Assessment is based on a final examination and may also include class participation and written or oral projects or problems throughout the semester.
