LAW - 5313 Family Law

The introductory course in Family Law provides the opportunity to explore some of the most important policy issues facing our society, i.e., how should the legal system regulate the creation of marriages and families, recognize rights and duties of family members while the relationship is ongoing, allocate rights and responsibilities upon its termination, and provide for the care of and contact with children when parental relationships break down. The role that government should play in regulating the private lives of its citizens is a basic theme that runs throughout the course. A primary goal of this course is to prepare students for the bar examination and for practice, so that students will be able to represent clients in domestic law matters with knowledge and skill. Students will examine both federal and state law, with special attention to Oklahoma family law statutes and selected Uniform Acts, focusing on the federal constitutional and statutory restraints upon state regulation and the diverse approaches taken by U.S. states to each issue. The three-credit hour course will include coverage of the following topics: I. Creation of Marriages and Families • Regulating Who May Marry and Methods of Marrying • Conflict of Laws and Recognition Principles • Recognition of Alternative Statuses • Rights of Cohabitants II. Rights and Duties Among Family Members During Marriage III. Dissolution of Marriage • Grounds and Procedure • Financial Issues - Property Division, Spousal Support, Tax Consequences, Antenuptial and Separation Agreements, Child Support, and Enforcement of Financial Obligations • Child Custody and Visitation • Jurisdiction and Enforcement across State Lines. The four-credit hour Family Law course will include all of the topics covered in the three-credit course. In addition, it will include more in-depth coverage of some or all of the following topics: I. Paternity Proceedings II. Adoption III. Indian Child Welfare Act IV. Legal Issues Related to Assisted Reproduction V. Domestic Violence and Protective Orders
