LAW - 5003 Criminal Procedure: Adjudication

(3 hours)

This course will survey the basic issues of criminal procedure from bail to jail, or from pretrial release through sentencing, appeals and collateral remedies. Topics which may be covered include bail, preventive detention, prosecutorial discretion, the preliminary hearing, grand jury indictments, venue, discovery, joinder and severance of defendants, the right to a speedy trial, guilty pleas, plea bargaining, rights to appointed counsel and effective assistance to counsel, trial by jury, selection of jury, the bench trial, the confrontation clause, the right to compulsory process double jeopardy, and appeals. Course objectives include learning the basic principles of procedural criminal law from pretrial release through post-conviction remedies, learning the basic tools and methods to analyze problems in the law of criminal procedure, and learning the policy issues and theory underpinning the law of criminal procedures.
